Adams, District Attorney ofLancaster County, by Deborah L. Greathouse, Assistant DistrictAttorney, respectfully requests. the Court to order a forfeitureof the following property: 1. The property seized was $220.00 in United StatesCurrency. 2. The property was seized on December 17, 2022 atapproximately 1:39 a.m. at 557 South Christian Street,Lancaster, Pennsylvania. 3 The owner of the property is Anthony Delgado. 4. The person in possession of the property at the time :ofseizure was Anthony Delgado. 5 The property is subject to forfeiture pursuant [to 42 Pa. C.S.A 5802, based |Section 5802 of the Judicial Code, 1upon the following averment of material facts: -3-On or about December 17, 2022, at approximately 1:39 a.m.,an Officer with the Lancaster City Police Department was onroutine patrol in.the 400 block of South Duke Street, Lancaster,Pennsylvania. While traveling in the block, the Officerobserved that the vehicle directly in front of him had darktint. The Officer ran the vehicle’s registration plate andlearned that the registration was suspended because of insurancecancellation. The Officer initiated a vehicle stop in the 500block of South Christian Street, Lancaster, Pennsylvania. TheOfficer radioed for back-up assistance. Officers approached the vehicle and observed the odor iofmarijuana emanating from inside. The driver of the vehicle wasidentified as Artemio Sanchez. Officers also saw that there werethree (3) individuals in the backseat of the vehicle andrequested that the windows be put down so the Officers could seeinside of the vehicle. Occupants were identified as follows:Johnell Trowery-Sibley was the front seat passenger; the reardriver side passenger was Anthony Delgado; the rear middle seatpassenger . was Emmanuel Remmy; and the rear passenger sideoccupant was Eddiezayah Morales. IT SHOULD BE NOTED THAT whenOfficers saw the individuals -in backseat, they appeared to ,bejuveniles; and that Officers observed marijuana “shake” residueall over the clothingof Johnell Trowery-Sibley. -4-When Officers spoke to the occupants, they observed AnthonyDelgado acting nervous and shaking. Due to his behavior,Officers removed him from the vehicle. On the person of AnthonyDelgado, officers located a Smith & Wesson 9mm handgun and abackpack. The: handgun was loaded with a magazine that containednine (9) rounds of ammunition, with one (1) round in thechamber. He was placed under arrest. and transported to theLancaster City Police Station. IT SHOULD BE NOTED THAT thefirearm had been reported stolen to the Lancaster City PoliceDepartment in July of 2016. Officers searched the backpack and located a baggie thatcontained approximately seven (7) bags of marijuana thatcontained a total of approximately two hundred and twenty (220)grams; one (1) clear ziplock bag that contained two (2) bags ofcocaine-each bag contained approximately one (1) gram in eachbag, for an approximate total of two (2) grams; approximately$220.00 in United States Currency; and drug paraphernalia toinclude a box of unused sandwich bags, a digital scale and apill bottle that contained partially smoked marijuanacigarettes. -5-Subsequently, Anthony Delgado was charged in Juvenile Courtwith Possession of a Firearm by a Minor; Firearms Not to beCarried Without a License; Possession with Intent to DeliverMarijuana; Receiving Stolen Property; Possession of Cocaine;Possession of Drug Paraphernalia and a Curfew violation. WHEREFORE, the Commonwealth of Pennsylvania respectfullyrequests Your Honorable Court to issue an Order of Forfeiturethat the property be adjudged forfeited to the Commonwealth andcondemned and that it be disposed of according to law.
